Halyna Hutchins' mother is marking the second anniversary of the late cinematographer’s on-set death at 42.
The Hutchins family isengaged in a civil lawsuitagainst Baldwin, 65, as a criminal investigation into the actor-producer’s role in the incident remains underway. The armorer onRust,Hannah Gutierrez-Reed, was charged with involuntary manslaughter in January and is expected to stand trial in February.
“There’s a family here that is hurting, that is in pain, that is suffering,” Allred told reporters, per ABC 13. “There was a real human being here who was shot to death that day, and we’re always going to remember Halyna.”

Baldwin was also charged with involuntary manslaughter along with Gutierrez-Reed in January, but New Mexico special prosecutors Kari Morrissey and Jason Lewisdismissed that charge in April, citing “new facts” in the case. Morrissey and Lewis said at the time they reserved the right to re-charge Baldwin; last Tuesday, they announced theyintend to present their case to a Santa Fe grand jurywithin the next two months.
“After extensive investigation over the past several months, additional facts have come to light that we believe show Mr. Baldwin has criminal culpability in the death of Halyna Hutchins and the shooting of Joel Souza,” the special prosecutors said in a statement.
“We believe the appropriate course of action is to permit a panel of New Mexico citizens to determine from here whether Mr. Baldwin should be held over for criminal trial.”

Baldwin’s attorneys Luke Nikas and Alex Spiro of Quinn Emanuel told PEOPLE: “It is unfortunate that a terrible tragedy has been turned into this misguided prosecution. We will answer any charges in court.”
The groupcompleted the moviewith Matthew on board as an executive producer, along with Academy Award-nominated producer Grant Hill (The Thin Red Line) and cinematographer Bianca Cline (Marcel the Shell with Shoes On) working in Hutchins' place.

Baldwin’s attorneys previously requested a judge dismiss Hutchins' family’s lawsuit against the actor in April.
